Washington D.C., 11 July 2026 — U.S. Citizenship and Immigration Services (USCIS) has published updated guidance on Form I-9 completion for beneficiaries of Temporary Protected Status (TPS) from Burma (Myanmar), Ethiopia, Haiti, Somalia, South Sudan, Syria, and Yemen.
The updates extend Employment Authorization Document (EAD) validity per ongoing court orders and provide clear instructions for employers on how to record expiration dates in Section 1 and Section 2 of Form I-9, as well as in E-Verify.
Key Takeaways from USCIS Guidance (July 10, 2026)
Employers should input "as per court order" in the Expiration Date field in Section 1.
In Section 2, enter the court-ordered extension date (e.g., July 17, 2026 for most countries, July 24, 2026 for Haiti).
Add a note in the Additional Information box referencing the relevant alert or TPS country page.
For E-Verify cases, use the court-ordered expiration date from the Form I-9.
USCIS recommends downloading and retaining the relevant alerts and TPS country webpages with affected Forms I-9.
Country-Specific EAD Extensions
Burma (Myanmar): Original expiration dates of Nov. 25, 2025, May 25, 2024, or Nov. 25, 2022 → extended per court order.
Ethiopia: Original expiration dates of June 12, 2024, and Dec. 12, 2025 → extended.
Haiti: Original expiration dates including Feb. 3, 2026, Aug. 3, 2025, and others → extended to July 24, 2026.
Somalia: Original expiration dates of March 17, 2023, September 17, 2024, or March 17, 2026 → extended.
South Sudan: Original expiration dates of Nov. 3, 2023, May 3, 2025, or Nov. 3, 2025 → extended.
Syria: Original expiration dates of Sept. 30, 2025, Mar. 31, 2024, and others → extended.
Yemen: Original expiration dates of Mar. 3, 2026, Sept. 3, 2024, or Mar. 3, 2023 → extended.
These extensions are described as “limited relief” until lower courts align with the U.S. Supreme Court’s Mullin v. Doe ruling from June 25, 2026.
