USCIS Extends Somalia TPS Employment Authorization Through August 14 Amid Ongoing Litigation

WASHINGTON, August 13, 2026 — U.S. Citizenship and Immigration Services (USCIS) has once again briefly extended the validity of employment authorization documents (EADs) for individuals granted Temporary Protected Status (TPS) for Somalia, this time through August 14, 2026 .

The latest extension, announced on August 12, 2026, supersedes the previous guidance issued on August 10, 2026, which had extended the documents through August 12 . This marks the fourth extension in less than three weeks, following a series of short-term reprieves as the program remains entangled in federal litigation.

The Legal Battle Behind the Extensions

The repeated extensions follow a June 25, 2026, U.S. Supreme Court ruling that permitted the Trump Administration to terminate TPS for Haiti and Syria . That decision is now influencing all ongoing TPS litigation, including the case concerning Somalia: African Communities Together et al. v. Noem et al., No. 26-cv-11201 (D. Mass.) .

A federal district court in Massachusetts has issued an order temporarily staying the termination of Somalia's TPS designation, which was originally slated to end on March 17, 2026.

For Form I-9 compliance, USCIS directs employers to follow these instructions :

When completing a case in E-Verify, employers should enter the expiration date of "Aug. 14, 2026" .
