Kenya Clarifies Visa-Free Rules: Entry Does Not Grant Work Rights

NAIROBI, September 7, 2026 — The Kenyan government has issued a definitive clarification that visa-free entry does not automatically give foreigners the right to work, trade, or operate businesses in the country.

The clarification, issued by Investments, Trade and Industry Cabinet Secretary Lee Kinyanjui on September 6, 2026, follows President William Ruto's directive targeting foreigners engaged in hawking and small-scale retail. Ruto stated that foreigners should not compete with Kenyans in low-capital activities and should instead focus on larger investments that create jobs.

Government Clarifies Misuse of Visa-Free Entry

Trade CS Lee Kinyanjui cited the "deliberate misuse of visa applications" by some visitors who enter Kenya under investor or tourist status but engage in activities outside the terms of their visas.

"Visa-free entry or exemption from eTA requirements does not in itself confer the right to engage in employment, trade or business in Kenya."

The government emphasized that Kenya's visa-free policy, introduced in 2024 and expanded in 2025, has boosted tourism and investment. However, easier entry does not remove separate legal requirements governing employment and commercial activities.

President Ruto's Crackdown on Foreign Hawkers

On September 2, while addressing Micro, Small and Medium Enterprise (MSME) traders at State House, President Ruto ordered foreign nationals engaging in small-scale hawking and trading to stop.

"We have not built investor confidence for hawkers to come to Kenya. What we have built is for investors, not traders and hawkers."

Ruto directed that foreigners involved in hawking and petty retail should close their businesses, with enforcement beginning September 7.

Visa Revocation Warning

Kinyanjui warned that foreigners found violating applicable visa provisions would have their visas revoked in accordance with the law.

"Persons found in contravention of the applicable visa provisions will have their visas revoked in accordance with the law."

The government identified cases where individuals on investor or tourist status were engaging in activities contrary to the provisions of their grant.

Foreigners with Permits Remain Protected

Foreign Affairs Principal Secretary Korir Sing'Oei clarified on September 6 that foreign nationals with the necessary work permits and licenses remain legally protected to operate businesses in Kenya.

"We assure that small or large traders & employees of all nationalities, with requisite documentation… remain legally protected."

Sing'Oei noted that reports suggesting Ruto had ordered a blanket closure of businesses owned by foreigners had taken the President's remarks out of context.

EAC Commitments and Regional Context

Kinyanjui noted that Kenya is a signatory to the East African Community and has committed to the free movement of goods and people across the Customs Union. These commitments remain an important consideration in implementing immigration and work permit requirements affecting citizens of EAC Partner States.

The clarification comes amid growing attention on foreign nationals' participation in Kenya's retail and hawking sectors, with the government seeking to distinguish between legitimate foreign investment and activities requiring specific work permits and approvals.

Proposed Local Content Bill

Ruto linked the crackdown to the proposed Local Content Bill, 2025, currently before Parliament. The bill seeks to identify economic activities that foreigners would not be permitted to undertake in Kenya. Ruto called on traders and stakeholders to engage with the proposed legislation to ensure loopholes allowing foreigners to engage in hawking and other small-scale businesses are sealed.
