Germany Extends 90-Day Residence Permit Waiver for Ukraine-Based Foreign Nationals — New Military Compliance Rule Takes Effect

BERLIN, October 8, 2026 — Germany has prolonged a special arrangement that lets certain foreign nationals who were living in Ukraine when the full-scale invasion began enter the country without first securing a residence permit. The waiver covers the first 90 days after arrival.

At the same time, Berlin has attached a fresh condition targeting men of conscription age. From October 9, 2026, those who owe military service duties under Ukrainian law must show they are meeting those duties before they can rely on the waiver.

The extension runs until December 4, 2027, giving eligible individuals roughly fourteen additional months to enter Germany under the scheme. The German Federal Ministry of the Interior set out the change in an official announcement issued in August 2026.

Why the Military Condition Was Added

The restriction did not appear in isolation. It follows a European Council decision stating that temporary protection should go only to people who are complying with their military obligations in Ukraine.

That reasoning now shapes German practice at the point of entry. Officials will expect documentary proof from affected arrivals — not simply a declaration.

The condition applies prospectively. Anyone already inside the EU before October 9, 2026 keeps their existing position, even if military obligations arise later through age or a call-up notice.

What Counts as Proof

For Ukrainian men who fall within the scope of conscription law, the burden sits with the traveller. Germany will look for evidence that the person either:

  • is not included in military service duties

  • holds a valid exemption or deferral

  • left Ukraine lawfully under Ukrainian rules

A Ukrainian exit stamp in the passport is the most straightforward form of evidence. Formal exemption or deferral documents also work.

Without something in that category, the 90-day waiver is unavailable.

Who Still Qualifies for the Waiver

The arrangement remains open to several groups, provided none of them has already obtained temporary protection in another EU member state:

The 90-day clock starts at first entry. The waiver holds only while no refusal decision has been issued.

Temporary Protection Runs to March 2028

Distinct from the 90-day waiver, the EU's temporary protection regime for Ukrainians now extends to March 4, 2028.

Germany implements this through Section 24(1) of the Residence Act. Permits already valid as of February 1, 2026 are being rolled over automatically, and work authorisation travels with them. Holders do not need to lodge a renewal application or attend an immigration office.

Roughly 1.3 million people from Ukraine currently hold temporary protection status in Germany or have applications pending.

One caveat: automatic rollover applies to Ukrainian nationals. Certain third-country nationals who previously held temporary protection do not benefit from the same automatic treatment.

Practical Implications

For Ukrainian men of conscription age planning to travel to Germany after October 9, 2026, preparation matters more than ever. A passport without a lawful exit stamp, or without exemption paperwork, is likely to leave the 90-day waiver out of reach.

For those already in Germany, or elsewhere in the EU, nothing changes retrospectively. Existing permits continue under the automatic extension.
