Washington D.C., 30 June 2026 — The Department of Homeland Security (DHS) has today published a Final Rule that formalises and clarifies the new online foreign national registration requirement first introduced through interim regulations in 2025. The rule, which codifies the existing process without expanding its scope, aims to strengthen immigration enforcement and improve tracking of certain individuals present in the United States.
What the Final Rule Covers
The registration requirement, which has been in effect since April 2025, primarily applies to:
Foreign nationals who entered the United States without inspection (EWI) and plan to remain for 30 days or longer.
Visa-exempt Canadians who entered at a land border and were not issued a Form I-94.
Foreign national children who turn 14 years old while in the US and will remain for 30 days or more (they must re-register even if previously registered).
The process involves creating a USCIS online account, submitting Form G-325R (Biographic Information – Registration), providing biometrics (fingerprints and photographs), and undergoing background checks.
Key Clarifications in the Final Rule
While the core obligations remain unchanged, the Final Rule introduces several helpful modifications based on public feedback:
Trusted Traveler Programs Exemption: Foreign nationals entering under programs such as Global Entry, NEXUS, or SENTRI are now explicitly exempt from the online registration requirement.
No New Categories Added: The rule does not expand the groups subject to registration.
Existing Registrations Honoured: Individuals who have already registered online for their current stay do not need to re-register (except children turning 14).
Proof of Registration: Registered individuals are reminded of the ongoing obligation to carry proof of registration at all times.
Who Is Exempt from the Registration Requirement?
Most lawfully admitted foreign nationals remain exempt, including:
Those who entered with a valid visa and were issued an I-94.
Lawful permanent residents (green card holders).
Individuals with Employment Authorization Documents (EAD).
Those who have filed certain qualifying applications (e.g., adjustment of status).
Practical Implications
For Affected Foreign Nationals: Those who entered without inspection or fall into the specified categories should complete the registration promptly to avoid potential civil or criminal penalties.
For Employers and Sponsors: Awareness of this requirement is important when onboarding or supporting foreign nationals who may not have been previously registered.
For Families: Parents must ensure children turning 14 comply with the re-registration rule.
The Final Rule reinforces long-standing registration obligations under the Immigration and Nationality Act while modernising the process through an online platform.
