CANBERRA, September 29, 2026 — Australia's Department of Home Affairs has quietly averted an administrative vacuum that could have left hundreds of entrepreneur visa holders unable to prove their eligibility for permanent residency.

The Migration (Complying Entrepreneur Activity – Funding Entities) Instrument 2026 (LIN 26/055) took effect on 25 September 2026, replacing a 2016 specification that was due to expire on 1 October . Without the replacement, applicants progressing toward permanent residency would have lost the legal instrument defining what counts as an "approved funding entity" — a core visa requirement.

Although the Entrepreneur stream of the Business Innovation and Investment Program (BIIP) closed to new primary applicants in July 2024, hundreds of provisional Subclass 188 visa holders are still progressing toward permanent residence under Subclass 888 .

To satisfy visa criteria, they must demonstrate that at least AUD 200,000 in third-party funding has been contractually committed by an approved entity .

The new instrument modernises the drafting but retains the existing four classes of acceptable funders :

Approved Funding Entity Class

Government agencies — Commonwealth, state, or territory

Publicly funded research bodies — established under legislation undertaking research or innovation initiatives

Venture capital partnerships — either registered or provisionally registered under the Venture Capital Act 2002

Institutions of higher education — categorized as Table A or Table B according to the Higher Education Support Act 2003

A higher education provider ceases to qualify if its approval is revoked or suspended .

Migration advisers are urged to refresh document checklists to ensure funding agreements clearly identify the entity's legal status and its inclusion in a prescribed class .

Applicants should retain evidence establishing :

• The identity and legal status of the funding entity

• The entity's inclusion within a prescribed class

• The existence and terms of the legally enforceable funding agreement

• The timing and amount of the funding

• The relationship between the funding and the entrepreneur's compliant activities

The Bigger Picture: BIIP Closed, National Innovation Visa Open

The wider BIIP remains permanently closed to new applications since 31 July 2024 . Business stakeholders should not assume the Entrepreneur stream will reopen .
