USCIS Finalizes Rule Ending 540-Day Automatic EAD Extensions
Updated: 1 hour ago
WASHINGTON, October 14, 2026 — U.S. Citizenship and Immigration Services has issued a final rule that permanently removes the 540-day automatic extension of Employment Authorization Documents for certain renewal applicants, formalizing an interim measure that has been in place since October 30, 2025.
The final rule was published in the Federal Register on October 14, 2026, and takes effect the same day.
What the Rule Does
The regulation ends the practice of automatically extending the validity of EADs — Form I-766 — for foreign nationals who timely file renewal applications in certain employment authorization categories. The modification is applicable to renewal applications submitted on or after October 30, 2025.
For impacted applicants, employment authorization now ends when the existing EAD card expires. It does not resume until USCIS approves the renewal application, unless the individual has a separate basis for work authorization to cover the gap.
The final rule makes no changes to the interim regulation issued last year. It does not affect EADs that were automatically extended before October 30, 2025, or those extended by law or separate Federal Register notice.
Who Is Affected
The final rule covers the following EAD categories:
Category | Description |
C09 | Adjustment of status applicants |
A3 and A5 | Refugees and asylees |
C08 | Applicants for asylum and withholding of deportation or removal |
A31 | Approved self-petitioners under the Violence Against Women Act and their qualified children |
C26 | H-4 spouses with an unexpired H-4 I-94 |
A12 or C19 | Temporary Protected Status |
For TPS holders, blanket auto-extensions may still apply if a separate Federal Register notice provides for an automatic extension for a defined class.
Who Is Not Affected
Two groups remain outside the scope of the change.
Spouses of L and E nonimmigrants remain work-authorized "incident to status" and do not require an EAD. Even if they elect to obtain an EAD, their underlying status provides work authorization beyond the card's expiration date as long as their status remains valid.
F-1 students applying for a STEM extension continue to receive a 180-day auto-extension upon timely filing of their STEM EAD application, under a separate regulatory provision.
Background
USCIS first introduced automatic EAD extensions in 2016, providing up to 180 days of continued work authorization for certain renewal applicants who filed timely in the same category.
In spring 2022, the agency temporarily increased the auto-extension period to up to 540 days to reduce the risk of work authorization gaps. That measure was made permanent in December 2024, effective January 2025.
In October 2025, USCIS issued an interim final rule eliminating the 540-day extension entirely, effective October 30, 2025. The final rule codifies that elimination without change.
What Employers and Foreign Nationals Should Do
The final rule continues the status quo that has been in effect since last October. Affected individuals — including adjustment of status applicants and H-4 EAD holders — should continue to file EAD renewal applications as early as possible to avoid or minimize potential gaps in work authorization.
Employers with affected employees should verify that renewal filings are submitted well ahead of expiration dates and consider whether any individuals require alternative work authorization documentation during the gap period.
