PRETORIA, October 12, 2026 — South Africa's Minister of Home Affairs has waived a long-standing requirement that certain in-country visa extension and change applications be filed at least 60 days before the applicant's existing visa expires.

The waiver, announced by the Department of Home Affairs, applies to future applications as well as those already awaiting a decision. It also extends to pending appeals against refusals that were based solely on the missed filing deadline.

What the Old Rule Required

The 60-day advance filing requirement generally applied to visas valid for more than 90 days. Under that rule, applicants seeking to extend a visa or change their visa status or conditions had to lodge their application well before expiry.

The practical effect was severe. The Department routinely received applications filed inside the 60-day window but refused them when it came time to review them — even where the visa itself remained valid at the time of filing.

What Changes Now

Applicants in this category may now file closer to their visa expiry date. The waiver removes the 60-day advance filing obligation, but it does not eliminate the core requirement: applications must still be submitted while the current visa remains valid.

The waiver also does not affect separate filing deadlines that apply to shorter visas. The seven-day deadline for visas valid for 30 days, for example, remains in force.

Impact on Pending Applications and Appeals

The waiver is retroactive in effect for certain pending matters.

  • Applications already awaiting a decision can benefit without further action from the applicant

  • Pending appeals against refusals based on the 60-day filing deadline are also covered

  • Applicants with pending applications or appeals do not need to submit anything additional — they can simply await a decision

This resolves a significant source of uncertainty for foreign nationals who filed inside the old window and were refused on procedural grounds.

What This Means for Applicants

The change introduces genuine flexibility, but it does not remove the need for careful planning.

Key points to remember:

Requirement

Status

60-day advance filing

Waived

Application must be filed before visa expiry

Still required

7-day deadline for 30-day visas

Unaffected

Pending applications and appeals

Covered automatically

Foreign nationals should continue to file well before their visa expires. Filing closer to the deadline is now permissible, but leaving too little time creates avoidable risk if documentation is incomplete or the application encounters processing issues.
