WASHINGTON D.C. — July 25, 2026 — U.S. Citizenship and Immigration Services (USCIS) has once again briefly extended the validity of Employment Authorization Documents (EADs) for individuals granted Temporary Protected Status (TPS) for Syria and Somalia, setting new deadlines of July 27, 2026, for Syria and July 29, 2026, for Somalia.

The extensions come in the wake of the Supreme Court's June 2026 decision in Mullin v. Doe, which permitted the Trump Administration to proceed with its plan to terminate TPS for Haiti and Syria. That decision is impacting ongoing litigation and DHS termination efforts for several other countries, including Somalia.

Why the Extensions Are Happening

Supreme Court Decision Impact

On June 25, 2026, the Supreme Court decided in Mullin v. Doe that federal courts are legally prohibited from reviewing non constitutional decisions made by DHS to end a country's TPS designation. The decision allowed the Trump Administration to proceed with its plan to terminate TPS for Haiti and Syria.

Ongoing Litigation

The Supreme Court decision is affecting the outcome of all ongoing TPS litigation, including for Somalia in African Communities Together et al. v. Noem et al., No. 26-cv-11201 (D. Mass.).

District Court Order

USCIS is also compelled, for the time being, to comply with a July 21 district court order related to TPS EAD auto-extensions for certain beneficiaries who filed EAD renewal applications before October 30, 2025.
